Bulk E-Mailer Victorious Over Blacklist Operator

Last Wednesday, a federal judge in Chicago ordered the Spamhaus Project, an international anti-spam organization, to pay $11.7 million in damages to e360 Insight LLC for blacklisting the company. The court also ordered Spamhaus to post a notice on its website indicating that e360 Insight is not a spammer.

Apparently, Spamhaus entered an appearance in the case but then failed to defend it, suggesting that the court did not have personal jurisdiction over the U.K. organization. As a result, the court ruled in favor of e360 Insight, a direct e-mail marketer who denies sending spam. Spamhaus has indicated that it will not comply with the court’s order and will continue to list e360 Insight as a spammer.

Update:  Apparently e360 has now been sued for violating the CAN-SPAM Act.
